General Terms and Conditions (T&Cs)

of ANKLANG Event & Marketing GmbH (hereinafter referred to as the “Organizer”)
FN 503579h, Rudigierstraße 10a/18, 4020 Linz

The following General Terms and Conditions (hereinafter referred to as “T&Cs”) apply generally to events of the organizer within the framework of the Woodstock Academy. Additional provisions (online and/or on site), in particular in the form of house rules of individual venues, general terms and conditions of other contractual partners (accommodation, catering, train tickets, etc.), etc. must be observed.

1. Sope of application

1. 1 The T&Cs govern the legal relationship between the Organizer and its customers who make use of the Organizer’s products and services and/or participate in an event organized by the Organizer (hereinafter referred to as the “Customer”). Every booking, every purchase of a ticket or visit to an event is based on these T&Cs.

1.2 The Organizer offers its services exclusively on the basis of these T&Cs. These apply to all legal relationships between the organizer and the customer, even if the customer is not expressly referred to them, and also apply equally to events and program components for which the organizer does not charge a fee.

1.3 In particular, the T&Cs are an integral part of contracts for participation fees for courses sold by the Organizer and/or participation fees for events organized and hosted by the Organizer

1.4 The T&Cs also apply in particular to contracts in which the aforementioned participation fees are paid via the Organizer’s sales partners (in particular its own online sales platform). In these cases, therefore, two T&Cs generally apply (namely the T&Cs of the organizer and the T&Cs of the sales partner). If there are any contradictions in this respect, the organizer’s T&Cs shall apply primarily, unless otherwise stipulated below.

1.5 The T&Cs also apply subsidiarily to events organized or hosted by cooperation partners of the Organizer. In such cases, these T&Cs shall apply subordinate to any terms and conditions of the respective third-party organizer.

1.6 The customer also obligates himself to comply with the general terms and conditions of the organizer’s sales partners and third party organizers.

1.7 The organizer does not accept the validity of the customer’s terms and conditions, even if these are known to the organizer, except in individual cases in which something else has been expressly agreed in writing. The organizer hereby expressly rejects such terms and conditions of the customer in advance.

2. participation fees

2. 1 Participation in the organizer’s events is only possible if the customer makes a booking in advance for such an event in the desired scope of services (basic offer or basic offer including selected additional offers) and pays the costs incurred for this in advance.

2.2 The payment of participation fees for an event of the Organizer does not cover any costs for meals, accommodation or travel to and from the event, unless expressly agreed otherwise. These costs are therefore to be borne by the customers themselves and are generally not included in the participation fees to be paid to the organizer.

2.3 Tickets or bookings for the events may only be purchased via the sales channels provided by the Organizer (in particular via the online store provided by the Organizer).

2.4 The purchase of tickets for resale for profit is prohibited without the prior written consent of the organizer.

2.5 The valid ticket must always be shown to the organizer’s staff on request.

2. 6 The data collected in the course of the respective purchase of tickets via the Organizer’s sales partners may be passed on to the Organizer without restriction.

2.7 Any duplication, copying, modification or further processing of invoices for tickets or of the ticket itself is expressly prohibited.

2. 8 Participation fees already paid will not be refunded by the organizer, unless otherwise stipulated below.

2.9 The organizer shall endeavour to implement the announced program of the respective event in its entirety. However, it may be necessary to postpone the event program or change program items at short notice. Even short-term postponements of the event content do not entitle the customer to return the ticket. It is the customer’s responsibility to find out about any changes at the beginning or during the respective event.

2.10 The organizer reserves the right to make artistic or organizational changes at short notice. Changes to the line-up (in particular to the artists and lecturers advertised for the event) and other changes to the advertised event schedule do not entitle the holder to return or exchange tickets or to a refund of participation fees.

3. Event times

3. 1 The event times announced by the organizer are approximate times, which may change considerably for technical and organizational reasons.

3.2 The organizer expressly reserves the right to change the event times at short notice if there are technical or organizational requirements to do so.

3.3 Claims for compensation by the customer due to a delayed or postponed (even at short notice) start of the event are excluded.

4. Cancellation policy

4.1 In the event of the complete cancellation of the Woodstock Academy or a chargeable additional offer before its start, participation fees already purchased can be returned to the organizer within two months of the planned end of the event against reimbursement of the participation fees actually paid. Shipping and/or insurance costs incurred by the customer for the purchase of the participation fees are not to be reimbursed by the organizer.

4.2 After expiry of this return period, a refund of the participation fees is no longer possible.

4.3 Furthermore, participation fees will only be refunded if an alternative date has not been offered within the return period and/or the cancellation or termination is due to a force majeure event.

4.4 In the event that an event is canceled, interrupted, postponed or the program changed, the customer shall not be reimbursed for any associated costs (such as accommodation, catering and/or travel costs).

5. Accreditation and ticketing

5. 1 For participation in the booked event or a specific program item, it is mandatory to carry the accreditation, which was handed over to the customer after full payment of the participation fees upon arrival at the accreditation office. The organizer reserves the right to check the accreditation or ticket at the entrances to the respective venue.

5.2 The accreditation also serves as authorization to use any shuttle service offered. For the use of mountain railroads within the framework of the Woodstock Academy, the ticket of the respective mountain railroad issued separately by the organizer on site must be presented. The respective terms and conditions of the carriers or mountain railroads apply. With regard to the use of the shuttle service and the mountain railroads, the customer is exclusively in a contractual relationship with the respective carrier or the respective mountain railroad.

5. 3 The loss of accreditation must be reported to the organizer immediately. Upon payment of a processing fee of EUR 10.00, a new accreditation for the remaining duration of the event will be issued to the customer after written confirmation of the loss of the original accreditation.

5.4 The transfer of accreditation to third parties is prohibited. Use is permitted exclusively for the respective customer of the organizer.

6. Domestic authority

6.1 Customers may be refused admission if there is reasonable cause to believe that they will disrupt the performance or cause a nuisance to other visitors.

6.2 Admission may also be denied to individual customers if they have not complied with the terms and conditions in previous performances or have given rise to (administrative) criminal prosecution or a civil dispute with the organizer or one of its contractual partners during the event.

6.3 Customers may be turned away from the performance in progress if they disrupt it, disturb other customers or have taken a seat for which they have not paid an attendance fee.

7. Behavior at the venues

7.1.1 Das Betreten des jeweiligen Veranstaltungsortes bzw. der Veranstaltungsräume ist nur während der vom Veranstalter freigegebenen Veranstaltungszeiten zulässig.

7.1.2 From the start of the construction work for the intended use of the event venue or the event rooms until the start of the event and after the end of the event until the completion of the dismantling and clearing work, the event venue or the event rooms and the adjoining handling, access and delivery area may not be entered by the customer without exception.

7.1.3 For safety reasons, it is not permitted to take bulky items to the event venues or into the event rooms.

7.1.7 Food and beverages may not be taken to the event venue or into the event rooms.

7.1. 8 It is not permitted to take along beverage cans, bottles, objects that can be misused as weapons or thrown objects, weapons or pyrotechnic objects (such as fireworks, Bengal fire, etc.) and these must be disposed of properly by the customer before entering.

7.2 Special regulations for the “Woodstock Academy”:

7.2.1 The “Woodstock Academy” takes place partly as an open-air event. The special features of the individual events require special care and understanding on the part of the visitors. For this reason, in addition to the above rules of conduct set out in section 7.1, the customer must in particular comply with the house rules currently applicable to these events at the respective venue and the site rules applicable to these events at the respective venue.

7.2.2 If the house rules and/or site rules conflict with the general rules of conduct in accordance with point 7.1, the house rules and/or site rules of the respective venue shall take precedence as special regulations.

7.2.3 The currently applicable house rules and site rules are displayed at the respective event venue and in the event rooms and can also be viewed at the following links: House rules.

7.2.4 The organizer reserves the right to amend the house rules and site rules up to the start of the respective event and also during the same if this appears necessary for organizational, legal, technical or other reasons in order to ensure that the event runs smoothly.

7.2.5 The customer undertakes to obtain sufficient information about the current status of the specific applicable house rules and site rules and to comply with these current rules without restriction.

7.2.6 The respective event and the respective event location expressly do not include the slopes, buildings and transportation facilities of the mountain railroads. In this sense, they are not part of the event site and are not subject to the organizer’s duty of care. The customer accepts this fact as well as the fact that by entering or using the slopes, buildings and transportation facilities of the mountain railroads, he/she accepts the T&Cs of the mountain railroads and is therefore obliged to comply with the associated conditions of carriage.

8. Responsibility for accompanying persons

8.1 The customer bears sole responsibility for the persons accompanying them, especially if they are still minors, do not have full legal capacity or are otherwise in need of protection, and even if they are not customers of the organizer.

8.2 The customer undertakes to ensure that his accompanying persons comply with these T&Cs even if they themselves are not customers of the organizer.

9. Sound and/or image recordings by the customer, copyright

9. 1 Without exception, the customer is not permitted to make sound and/or image recordings, in particular photos, videos and sound recordings of the instructors, artists, workshops, lectures and performances without express prior permission.

9.2 In the event of non-compliance with these provisions, the customer may be excluded from the event without entitlement to a refund.

9.3. The working documents, brochures, handouts, etc. used during the course are protected by copyright and may not be reproduced or used commercially without the consent of the organizer or the respective lecturer.

10. Sound and/or image recordings by the organizer

10.1 The customer hereby expressly agrees that the organizer and its contractual partners may make sound and/or image recordings, in particular photos, videos and sound recordings of the customer at the event.

10.2 Furthermore, the customer expressly agrees that such photographs may also be taken in such a way that the customer is clearly identifiable and depicted in full.

10.3 The customer gives his express consent for the organizer to exhibit the recordings made by the customer in a picture and/or video gallery, both in person and on the Internet, without restriction as to duration. This includes in particular the organizer’s galleries on its homepages and its social media presence. This also applies to any other media that are already available or will be developed at a future date after the event has taken place.

10.4 The customer expressly agrees that the organizer may also use the photographs taken by the customer for the production of prominent and large-scale advertising subjects – in particular flyers, advertising banners, posters, merchandise articles, etc.

10.5 The customer also gives his express consent for the organizer to pass on the recordings made by the customer to public and private media (in particular newspapers, radio and television stations, online news) without restriction for the purpose of reporting on and advertising the event and for these recordings to be used by third parties in all known and unknown ways.

10.6 The customer expressly agrees that the organizer may use the recordings made by the customer for advertising purposes without restriction.

10.7 The customer expressly agrees that the organizer may pass on the recordings made by the customer to third parties for advertising purposes without restriction.

10.8 The customer expressly waives any remuneration for the use of the recordings made at the event.

12. Arrival and departure

12.1 Customers are requested to observe all applicable entry and visa regulations for travel to Austria and Tyrol in particular. Visas can only be issued by Austrian representation authorities or accredited representations abroad. The organizer cannot influence the entry or visa process.

12.2 The organizer does not offer travel insurance. Travel costs are not included in the participation fee.

13. Accommodation

Customers have the option of booking accommodation through the local tourism associations. The respective booking and accommodation conditions apply.

14. Pandemic clause

14.1 In the event of disease outbreaks, official closures or restrictions in connection with SARS-CoV-2/COVID-19 or similar epidemics or pandemics that make it impossible to hold events or individual program items and result in cancellation without substitution, the participation fee will not be refunded by the organizer – to the extent permitted by law. Any additional costs incurred by the customer (hotel, travel, etc.) shall be borne by the customer. In this case, the organizer will inform the customer in good time, provided that contact details have been made available.

14.2 Any resulting postponement of events (both in the basic and additional offer) to another date is – as far as legally permissible – in any case not a reason for a refund or reduction of the ticket price. If paid events or parts thereof cannot take place on the scheduled dates due to events of force majeure, participation in the program will be transferred to the next time the event is held, to the extent permitted by law.

15. Limitation of liability

15.1 The organizer is liable to the customer – to the extent permitted by law – only for intent and gross negligence, except in the case of injury to life, limb or health of a person. In the event of alleged intent or gross negligence, the customer must prove the existence of such. Compensation for indirect damage and consequential damage, including loss of profit, is excluded in any case.

15.2 In this context, the customer expressly acknowledges that due to the volume of the event and the performances taking place, the risk of damage to health – in particular hearing damage – cannot be ruled out. The customer is independently responsible for the hearing protection required depending on the situation and the organizer has no duty of care in this regard.

15.3 The organizer accepts no liability for the loss of or damage to items brought by customers. It is therefore recommended that no objects (especially musical instruments) or important materials be brought to or left in the venues and event rooms. Claims for damages against the organizer are – as far as legally permissible – excluded.

15.4 After the end of the event or after the venue has been closed, the organizer assumes no liability whatsoever in connection with visitors who are still in or on the venue or who re-enter the venue after it has been closed.

16. Data protection regulations

16.1 The organizer processes personal data only in accordance with the principles of the GDPR, in particular Art. 5 und Art. 6 DSGVO, und des DSG. This means that the organizer only processes data in accordance with the principles of lawfulness, processing in good faith, transparency, purpose limitation, data minimization, accuracy and timeliness, storage limitation, integrity and confidentiality.

17. Final provisions

17.1 The (pre-)contractual business relationship between the customer and the organizer shall be governed exclusively by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods and the reference norms of private international law (IPRG, EVÜ).

17.2 The language of the contract and the language to be used in any disputes is German.

17.3 It is agreed that the competent court at the registered office of the organizer shall have exclusive jurisdiction.

17.4 Should individual provisions of the contract or these GTC be or become invalid in whole or in part, or should the contract or these GTC contain an unforeseen loophole, the validity of the remaining provisions or parts of such provisions shall remain unaffected. The invalid or missing provisions shall be replaced by the respective statutory provisions.

17.5. The binding version of the GTC is always the version that was valid at the time the contract was concluded with the respective customer.
